Class 10

Class 10: Private standards in public law  / copyright issues

Readings/other material:

1. Read Pam Samuelson, Questioning Copyright in Standards. Boston College Law Review, Vol. 48, 2007; UC Berkeley Public Law Research Paper No. 925044. Available at SSRN: http://ssrn.com/abstract=925044.  Focus on her introduction, her brief discussion of the Veeck case, and the concluding section titled “Incentives and Competition Policy Concerns about Copyrights in Standards.”  For the purposes of our discussion don’t worry about understanding her more nuanced discussion of copyright law doctrines.

2. Review the 1-paragraph statement found on the ANSI page titled ANSI Position on Protection of Copyright for Standards Referenced into Public Law.  Click through and briefly review the four linked documents found on that page.  Reading the ANSI amicus brief in Veeck is encouraged but optional.

3.  View the slide show “Code City.” View the related four minute video “IP3TV Special Report.”
